This website (www.therentalstudio.com and www.therentalstudio.in) is owned and operated by Aspirebels Private Limited (''Company''), a company duly registered and incorporated under the Companies Act, 1956, with a registered address at B-11, Talwandi, Kota, Rajasthan, 324005, India.

The Website is made available to you by the Company subject to your acceptance of these Terms and Conditions and our Privacy Policy (collectively the "Agreement" or the "Terms"). Please review the Agreement carefully. If you do not agree to these terms, you should not use the website or review information or have any transactions on the website.

When we refer to "we," "our" or "The Rental Studio," we refer to Aspirebels Private Limited. When we refer to "you" or "your," we refer to you, the person who uses the renting Services through our Platform.

1. Definitions

  • Article: Any good or product available for rent through The Rental Studio market platform.
  • Rental Agreement: The agreement between Users, consisting of these Terms and the specific conditions presented by LENDER on the Platform associated with the particular Article.
  • RENTER: A natural or legal person renting Articles through The Rental Studio, not directly linked to their main commercial, industrial, artisanal, or professional activity.
  • LENDER: A natural or legal person managing rental operations using our software, providing goods for rent through the Platform, as a commercial, industrial, artisanal, or professional activity.
  • Marketplace ("Service"): The website managed by The Rental Studio, available at https://www.therentalstudio.com and/or https://www.therentalstudio.in.
  • User: Natural or legal person with full legal capacity to give or receive for rent items listed on the Market Platform, in accordance with Indian law.
  • Cooling Off Period: The period during which a RENTER can cancel a request to rent an item without incurring any charges. This period extends from the time of making the request until it is accepted by the LENDER or up to 48 hours before the estimated delivery date, whichever comes first. If the request is made within 48 hours of the start date, the cooling-off period is reduced to 1 hour after the request is submitted. During the cooling-off period, the RENTER is eligible to receive a full refund upon cancellation.
  • Order: A RENTER's request to rent one or more items from an online rental platform. An order is a comprehensive transaction that encompasses the selection and reservation of one or more products or services offered by various LENDERS through the platform. An order may include a combination of items from different LENDERS and is created when a RENTER adds products to their cart and proceeds with the rental process.
  • Suborder: A specific component of an order, corresponding to the rental of all the products offered by a particular LENDER within the order. Each suborder is treated as an independent and separate transaction, and RENTERS receive distinct notifications and information for each suborder. Suborders may have unique delivery dates, referred to as "Billing Dates," which mark the start date for the rental of all the products associated with that specific LENDER'S suborder.
  • Substantial Size: Refers to the physical dimensions and weight of items being rented that exceed the practical limits for easy manual transport or handling.
  • Rental Duration: Refers to the duration of the Order

2. Rental Duration

Rental plans may vary depending on the category of item being rented. The following categories are recognized:

  1. Daily Rentals: Rentals that are 30 days or less in duration.
  2. Monthly Rentals: Rentals that are 30 days or more in duration.

RENTER placing an order from the website(s) will be in contract with the LENDER for the entire duration from the date of delivery until the duration of items and the product(s) are returned to the LENDER unless terminated earlier or extended as mutually decided by Users.

Company acts as a mediator in these rental transactions and defines the specific terms and conditions, which will remain the same for every LENDER. LENDER retains the ownership of the equipment given on a rental basis. RENTER is forbidden from sub-leasing the equipment to any third party for any material or non-material gain. RENTER must keep the Company informed in writing of any change in their location/constitution/profession/business address in all departments. It is Company’'s responsibility to inform the LENDER about the said changes.

While the ownership during the Rental Duration at all times shall reside with the LENDER, products once accepted by the RENTER shall become the responsibility of the RENTER until the Rental Duration is complete and products are returned to the LENDER.

RENTER is required to receive the equipment in good condition only. Once the LENDER’S equipment is accepted by the RENTER, it will be assumed that the articles have been received in good condition and as per the order requirements. Company or LENDER has every right to terminate the contract and take back the items if they deem the RENTER is misusing or being extremely negligent with the items.

3. RENTER KYC

Given the nature of the goods, all RENTERS are required to complete an online KYC form to confirm the order. In order to do so, RENTERS will be redirected to www.therentalstudio.com/settings once they have made the payment. Company uses the help of 3rd party verification companies to authenticate RENTER details. By doing so, Company agrees that it will secure the user data and prevent any third party from accessing the Services or the Intellectual Property therein except as expressly permitted under the terms of this Agreement. The Company shall preserve and retain user data as required under applicable law.

Required Documents for RENTER KYC:

  • Government ID (Aadhaar Card)
  • Address Proof (Rental Agreement, Electricity Bill)
  • Work ID Card/College ID Card/Proof of employment (payslip or invoice) dated in the last 3 months
  • Photo Selfie (Current Picture)
  • Social Media Handles (LinkedIn, Instagram, Facebook)
  • Pan Card
  • Bank Statement (Last 3 months)
  • Owner name and number (if rental agreement)
  • Alternate Phone Number

Company might request additional documents on a case-to-case basis. The same will be notified via email or SMS.

LENDER may request you to show some form of government-issued identification at the time you collect the booked Item. Your failure to present personal identification will give LENDER the right to terminate the Booking without incurring any liability.

4. Product Description

We do not warrant that Article description or other content of this Website is accurate, complete, reliable, current, or error-free and assumes no liability in this regard.

Company does not make any representation or warranty as to specifics of the images displayed on the Website and the images have no bearing on the quality of the products displayed. RENTER shall take no inference based on the picturization of the products offered. That being said, reasonable efforts are taken to ensure the accuracy and integrity of information and related materials provided by the Company on this Website, but the Company is not responsible for misprints, out-of-date information, technical or pricing inaccuracies, typographical or other errors appearing on this Website.

Kindly note that the price indications displayed on our website are subject to change without prior notice. This is because, on rare occasions, technical issues, typographical errors or changes in product information may cause variations in the prices displayed. LENDER reserves the right to change the prices of their offerings on the website at any time as per their business needs.

5. Payment Policy

Company rentals work on a Prepaid Intermediary Model. In respect of the Articles you Rent on the Website, a rental fee (“Rental Fee”) shall be payable which shall be the total of the fee payable towards rental of a Article, applicable taxes, insurance charges (if applicable), Labour Charges (if applicable), transaction fee (if any) and the Logistics Charges. It is clarified herein that in case of rent transaction, the Logistic Charges shall include delivery and pick up of the Product from the address. A refundable security deposit (“Security Deposit”) shall also be charged to you for each Article you rent. An order will not be considered as to be placed if this rental amount and Security Deposit are not paid in advance of delivery.

Each order placed with a different LENDER and added to the cart is considered a distinct Suborder. An order may consist of one or more Suborders, depending on the RENTER'S choices.

For example, if a RENTER orders products that contain two Suborders - a bed and mattress from LENDER X (“Suborder 1”) and a wardrobe from LENDER Y (“Suborder 2”) - on July 19th, and the items are delivered in two separate shipments, with the bed and mattress from LENDER X delivered on July 24th and the wardrobe from LENDER Y delivered on July 29th, then the RENTER’S billing cycle for "Suborder 1" will start from the 24th of each month and end on the 23rd of the following month. On the other hand, the billing cycle for "Suborder 2" will start on the 29th of each month and end on the 28th of the following month.

The confirmation of the Suborders from the LENDER may require up to 24 hours. Upon confirmation, the RENTER will receive an email notification for each Suborder. In the event that confirmation is not received from the LENDER, the Company will offer an alternative solution. RENTER can then choose whether to accept the alternative option or cancel the Suborder to receive a full refund of that particular suborder. In either case, the RENTER will be promptly notified. Refer to the Clause VIII of this Agreement.

RENTER acknowledges and agrees that the Company acts as the mediator for the limited purpose of accepting payments from RENTERS on behalf of the LENDERS, as the case may be. Upon your payment of the amount to us, which is due to the LENDER, your payment obligation to the LENDER for such amounts is completed, and we are responsible for remitting such amounts to the LENDER. You shall not, under any circumstances whatsoever, make any payment directly to the LENDER for Order bookings or for delivery of the Order or completion of the task made using the Platform. RENTER shall make all payments to the Company only. Company shall not be liable for any payment made to any broker/third party by the RENTER.

MODES OF RENTAL

Per-Month

In case of a subscription contract (mode of rental is per month), RENTER would be required to pay the monthly rent as per the Billing Cycle. Company team would be giving a reminder two days before the start of the next cycle and the buffer period allowable in this case would be 4 days from the Billing Date. Payment made beyond the Due Date shall incur a late fee. Late fees shall be levied on the rental due amount only.

On the 5th day of delay, a late fee of 10% will be applied, and thereafter, an additional 1% will be added for each subsequent day of delay. In the event of default beyond the 16th day, Company reserves the right to visit and collect the items, with or without the consent of the RENTER and without prior intimation as well.

RENTERS are required to complete the NACH mandate, and the order cannot be delivered until this step is completed. By Signing the NACH mandate form, the RENTER declares that the particulars provided in this mandate are correct and complete and hereby agrees to participate in the NACH and make payments through the NACH platform according to the terms and conditions thereof. RENTER authorizes the bank to debit their account for any charges related to mandate verification, registration, transactions, returns, or any other applicable fees associated with their participation in NACH.

RENTERS must ensure sufficient funds are available in their bank account on the day of the Auto Debit transaction.

It is the RENTER’S responsibility to pay the invoice amount before the due date. If the amount is not paid by the due date, the Company will debit the RENTER’S bank account on the due date. In case of ECS/Standing Instructions dishonor, the Company will impose a fee of Rs. 500/-. Additionally, your bank may levy further charges on the same. It's important to note that the Company will neither refund nor cover any charges applied by the bank on the RENTER.

Company is not responsible for any bank charges debited from the RENTER’S bank account by the destination bank due to payment through NACH. Company is entitled to exercise all rights and remedies available in the case of dishonor of a cheque in the event of dishonor of electronic funds transfer instructions/NACH Auto Debit mandates due to insufficient funds, as per Section 138 of the Negotiable Instruments Act, 1881.

RENTER agrees and acknowledges that Company will not be held responsible for any delay and/or failure in debiting RENTER’S bank account for reasons not attributable to the negligence and/or misconduct on the part of Company

RENTER can request an extension of their per-month rental by contacting our customer support team or making the request through their online account. Extension requests should be made before the initial order completion date expires to ensure a smooth process.

The extension of a per-month rental will be charged on a per-month basis. The monthly rental rate for the extension period will be calculated based on the initial rental amount and Rental Duration.

In addition to the monthly extension charges, a penalty of Rs 500 may apply for any losses incurred by LENDER due to the extension without prior notice. Losses might include the unavailability of the rented item for other RENTERS, logistical challenges, or scheduling conflicts caused by the extension. RENTERS are liable to pay both the monthly extension charges and the penalty amount, if applicable. payment for the extension should be made promptly, and the extension will be confirmed once the payment is received.

One Time

RENTERS may be asked to complete the NACH mandate on a case-to-case basis, and the order will not be delivered until this step is completed. By Signing the NACH mandate form the RENTER declares that the particulars provided in this mandate are correct and complete and hereby agrees to participate in the NACH and make payments through the NACH platform according to the terms and conditions thereof.

RENTERS can request an extension of their one-time rental by contacting our customer support team or making the request through their online account. Extension requests should be made before the initial order completion date expires to ensure a smooth process.

The extension of a one-time rental will be charged on a per-day basis. The daily rental rate for the extension period will be calculated based on the initial rental amount and Rental Duration.

Suppose a customer rents a product with a one-time payment of Rs 1000 for a 10-day duration. If a customer decides to extend this period by 3 more days, the daily rate, based on the initial payment of Rs 1000 for 10 days, would be Rs 100 per day. Therefore, the extension for 3 days would incur an additional cost of Rs 300

Suppose a customer rents a product with a one-time payment of Rs 18,000 for a 6-month period. Now, a customer wants to prolong their usage of the product for an additional 10 days. Using the Rs 18,000 price for 6 months (equivalent to 180 days), the daily rate can be calculated as Rs 100. Therefore, extending the product for 10 more days would incur an additional charge of Rs 1,000.

In addition to the daily extension charges, a penalty of Rs 500 may apply for any losses incurred by LENDER due to the extension without prior notice. Losses might include the unavailability of the rented item for other RENTERS, logistical challenges, or scheduling conflicts caused by the extension. RENTERS are liable to pay both the daily extension charges and the penalty amount, if applicable. Payment for the extension should be made promptly, and the extension will be confirmed once the payment is received. While the LENDER ensures there are no problems with the items, in case of any issue please do not hold the payment of the rent as the two are separate and Company cannot help if late charges are incurred because of the same.

You represent and warrant that if you are making any payments to us that:

a. Any credit, debit, net banking, cheque, UPI or any other mode of transfer information supplied by you is true and complete b. Charges incurred by you will be honored by your credit card/debit card/banking company, and c. You will pay the charges incurred by you at the posted prices, including any applicable taxes.

While availing the payment method/s available on the Website, Company shall not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to Lack of authorization for any transaction/s, or Exceeding the present limit mutually agreed by You and between "Bank/s", or Any payment issues arising out of the transaction, or Decline of transaction for any other reasons.

All payments made against the services from Company by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. We will not facilitate a payment with respect to any other form of currency. By making a payment, you have specifically authorized the Company, its service providers to collect, process, facilitate and remit payments. You understand, accept and agree that the payment facility provided by Company is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment, collection and remittance facility for the transactions on Company Website using the existing authorized banking infrastructure and payment gateway networks.

The Company shall levy a charge of Rs. 400/- for each cheque return/bounce or ECS/Standing Instructions dishonor.

6. Security Policy

A security deposit is a financial guarantee provided by RENTER to cover potential damages, losses, or breaches of the Rental Agreement.

In addition to the rental, the RENTER shall pay a refundable security deposit (“Security Deposit”). The refundable deposit does not include any rent. It is simply a security deposit that takes care of the damages or loss (if any). The Security Deposit shall not carry any interest for the entire tenure.

Company holds the deposit temporarily to ensure the safety and integrity of the rental process. The amount of the security deposit is determined by the LENDER and is clearly stated in the rental listing. It may vary based on the value and condition of the rented product. As a RENTER, you are responsible for reviewing and accepting the security deposit amount when making a booking. The security deposit received by the Company is promptly transferred to the LENDER after the Suborder is delivered to the RENTER and the LENDER holds the security deposit for the duration of the rental period and for a reasonable time afterward, usually up to 21 days. This allows for any potential post-rental claims or disputes to be resolved.

If there are no issues or disputes related to your rental, the security deposit will be released back to your payment method within the hold period. Please note that the timing of the release may depend on the financial institutions involved. In the event of any disputes or concerns related to the security deposit or its release, we encourage you to communicate with the LENDER on our messaging platform to attempt to reach a resolution. If a resolution cannot be reached, Company may step in and facilitate a resolution process. In case any damage is found in any Article, the LENDER shall have the right to deduct the charges for the damages or dues from the Security Deposit paid by the RENTER and shall refund the remaining amount to the RENTER. In case of default in the payment of rentals (including late fee) or if the RENTER misses the agreed deadline for return, LENDER shall have the right to deduct such rental dues from the Security Deposit.

The Security Deposit shall not include any rental. RENTER cannot request for the invoice dues to be adjusted from the Security Deposit.

7. Delivery Policy

Company is only providing a platform for communication between Users and does not provide any pick-up and delivery services with respect to the Orders placed by RENTERS on the Platform. In case of complaints by the RENTER for deficiency or lapse in the delivery services, Company shall notify the same to the LENDER and also assist RENTER to the best of its abilities to enable a satisfactory resolution of the complaint.

Delivery of an order placed by you through the Company platform may either be undertaken directly by the LENDER against whom you have placed an order, or facilitated by the LENDER through a third party who may be available to provide delivery services to you. In both these cases, the Company is merely acting as an intermediary between you and the LENDER and shall not be responsible for any delivery services and assumes no liability for disputes arising out of the same. RENTER’S Order will be only delivered to the address designated by him/her at the time of placing the Order on the Platform. RENTER’S Order will be canceled in the event of any change of the address as informed by the LENDER and RENTER shall not be entitled to any refund for the same. Delivery of products in the event of change of the delivery location shall be subject to acceptance by the LENDER or sole discretion of the Company.

If the items being rented are of Substantial Size and require elevator access or access to building premises, the RENTER shall undertake to provide adequate directions, information, and authorizations to accept delivery. Please note that the necessity for elevator access or building premises will be determined based on the size of the items and shall be determined at the discretion of Company or the LENDER.

In the event that elevator access or access to building premises is deemed necessary due to the size of the items, there may be a labor charge involved for picking up and conveying the items via stairs, the charges will be notified to the RENTER on the spot. Any additional charges incurred in this regard shall be borne by the RENTER, subject to acceptance by the LENDER or at the sole discretion of Company.

RENTER must be present in person to take or receive the delivery of the products. In case the RENTER is not present or has not assigned a representative for taking delivery, at the location and a second delivery attempt is required, Company or LENDER shall charge an extra delivery cost to the RENTER. The RENTER must examine the products before accepting its delivery and shall be deemed to have satisfied himself as to its condition and suitability for his/her purpose, and its compliance with any prescribed safety standards. After the delivery, any fault in the products shall be dealt with in accordance with the terms of the Rental Agreement. Under no circumstances should the RENTER offer payment to any individual during the delivery, unless explicitly directed by the Company. If the RENTER proceeds to make a payment, the Company cannot be held responsible for such transactions.

RENTER should work together with the LENDERS to agree on a suitable delivery date and time. We recommend discussing and confirming these details well in advance to ensure a convenient exchange. They must utilise the messaging system to discuss delivery logistics, including date, time, and any specific requirements. In the event of any delays or changes, the RENTER must communicate promptly with the LENDER to accommodate each other's schedules.

QUALITY CHECKS DURING DELIVERY

Upon delivery, we kindly request RENTERS to meticulously inspect and confirm the quality and specifications of each item before accepting the delivery. If the RENTER identifies any issues or discrepancies, they are required to bring it to the attention of the delivery personnel immediately and have it recorded by reaching out to the customer support team of the Company.

However, we understand that unforeseen circumstances may arise. Therefore, RENTERS are provided an additional two-hour window within which they must promptly report any product-related issues to the Company. The RENTER is responsible for ensuring that all products are in the condition as specified.

8. Cancellation and Refund Policy

RENTERS may cancel their Order or Suborder through our website, and the cancellation is effective immediately. Whether the RENTER receives a full refund, a partial refund, or receives no refund depends on the circumstances. The total amount refunded will depend on when the RENTER cancels the Order or Suborder, length of the tenure and the payment mode.

FULL REFUND: COOLING OFF PERIOD AND CANCELLATION BEFORE ORDER CONFIRMATION

RENTER can cancel a request to rent an item at any time before the request is accepted by the LENDER or 48 hours before the estimated delivery date, which is known as the Cooling off period. If the Order is placed within 48 hours of the start date, the Cooling off period period is reduced to 1 hour after the Order is placed. If you cancel before the request has been accepted or within the Cooling off period, you will receive a full refund.

PARTIAL REFUND: CANCELLATION OUTSIDE THE COOLING OFF PERIOD

If a RENTER wants to cancel an order, they are encouraged to notify the LENDER via Company messaging system as soon as possible and to process the cancellation themselves through the website. We’ll issue a partial refund to RENTERS who cancel in this manner and do not fall within the free cooling off period.

Per-month

In case of per-month transactions, 50% of the rental amount will be charged. From a minimum of Rs 100 to a maximum of Rs 5000. In addition to these fees, transaction fees may apply. Rest of the amount will be refunded to you.

For example, if you rent an item with a value of Rs 109 per month for 3 months, the fee would be Rs 100 + transaction fee(if any). For example, if you rent an item with a value of Rs 1499 per month for 6 months, the fee would be Rs 750 + transaction fee(if any). For example, if you rent an item with a value of Rs 14559 per month for 9 months, the fee would be Rs 5000 + transaction fee(if any).

One-time

If the rental period is no more than 15 days, you will be charged 10% of the rental amount paid. From a minimum of Rs. 100 to a maximum of Rs. 1000. In addition to these fees, transaction fees may apply. Rest of the amount will be refunded to you.

For example, if you rent an item with a value of Rs 749 for 10 days, the fee would be Rs 100 + transaction fee(if any). For example, if you rent an item with a value of Rs 1329 for 12 days, the fee would be Rs 133 + transaction fee(if any). For example, if you rent an item with a value of Rs 14449 for 15 days, the fee would be Rs 1000 + transaction fee(if any).

If the rental period is more than 15 days but no more than 30 days, you will be charged 10% of the rental amount paid. From a minimum of Rs. 250 to a maximum of Rs. 2500. In addition to these fees, transaction fees may apply. Rest of the amount will be refunded to you.

For example, if you rent an item with a value of Rs 1498 for 20 days, the fee would be Rs 250 + transaction fee(if any). For example, if you rent an item with a value of Rs 2658 for 19 days, the fee would be Rs 266 + transaction fee(if any). For example, if you rent an item with a value of Rs 32969 for 30 days, the fee would be Rs 2500 + transaction fee(if any).

If the rental period is more than 30 days, you will be charged 10% of the rental amount paid. From a minimum of Rs. 500 to a maximum of Rs. 5000. In addition to these fees, transaction fees may apply. Rest of the amount will be refunded to you.

For example, if you rent an item with a value of Rs 9498 for 6 months, the fee would be Rs 950 + transaction fee(if any). For example, if you rent an item with a value of Rs 2388 for 3 months, the fee would be Rs 500 + transaction fee(if any). For example, if you rent an item with a value of Rs 165950 for 12 months, the fee would be Rs 5000 + transaction fee(if any).

PARTIAL REFUND: CANCELLATION ON THE ESTIMATED DELIVERY DATE

If a RENTER wants to cancel an Order or Suborder, they are encouraged to notify the LENDER via Company messaging system as soon as possible and to process the cancellation themselves through the website. We’ll issue a partial refund to RENTERS who cancel in this manner and do not fall within the free cooling-off period.

Per-month

For monthly transactions, the entire rental amount for the first month will be billed, along with a potential penalty of up to Rs 5000, at the discretion of the LENDER or Company. In addition to these fees, transaction fees may apply.

For example, if you rent an item with a value of Rs 109 per month for 3 months, the fee would be Rs 109 + transaction fee(if any) + Penalty(if any).

For example, if you rent an item with a value of Rs 1499 per month for 6 months, the fee would be Rs 1499 + transaction fee(if any) + Penalty(if any).

One-time

If the rental period is 15 days or less, you will incur a charge equal to 50% of the paid rental amount, with the possibility of upto Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges. Any remaining balance will be refunded to you.

For example, if you rent an item with a value of Rs 749 for 10 days, the fee would be Rs 375 + transaction fee(if any).

If the rental period is more than 15 days but no more than 30 days, you will incur a charge equal to 40% of the paid rental amount, with the possibility of a Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges. Any remaining balance will be refunded to you.

For example, if you rent an item with a value of Rs 1498 for 20 days, the fee would be Rs 599 + transaction fee(if any).

If the rental period is more 30 days, you will incur a charge equal to 20% of the paid rental amount, with the possibility of a Rs 5000 penalty. Please note that transaction fees may also be applicable in addition to these charges. Any remaining balance will be refunded to you.

For example, if you rent an item with a value of Rs 2388 for 3 months, the fee would be Rs 478 + transaction fee(if any).

CANCELLATION DUE TO ANY OTHER REASONS

Cancellation Due To Suborder Rejection by LENDER

If a LENDER rejects a Suborder, the Company will propose an alternative solution. Suborder not confirmed within 48 hours of the booking is also considered as rejected. RENTER can then decide whether to accept the offered alternative or cancel the specific Suborder to receive a full refund for that particular Suborder. Suborders may be rejected for the following reasons:

  1. Item Unavailability: The LENDER may have initially listed an item for rent, but subsequently discovers that it is no longer available due to unforeseen circumstances, damage, or other factors.
  2. Overbooking: In situations where a LENDER has multiple listings for the same item and receives multiple rental requests for the same time frame, they may need to reject some suborders to prevent overbooking.
  3. Maintenance or Repairs: The LENDER may need to decline a suborder if the item requires unexpected maintenance or repairs that cannot be completed within the agreed-upon rental period. RENTER acknowledges that the cancellation of a Suborder will not impact the overall order, including any other Suborders (if applicable), in any manner.

Cancellation Due To Bad condition or not as specified

RENTER's Responsibility:

  • The RENTER must promptly notify Company or LENDER of the unsatisfactory condition or discrepancies between the received item and the provided item description.
  • It is essential for the RENTER to provide photographic evidence illustrating the issues with the item's condition or the deviations from the provided description.
  • The RENTER is required to send photographs of the item's condition within 2 hours of receiving the product.
  • If the RENTER notifies about any issues or concerns after 2 hours of receiving the order, they'll be treated in accordance with the damage policy.

Investigation and Resolution:

  • Upon receiving the RENTER’S complaint and photographic evidence, the Company will initiate an investigation into the matter.
  • Company will facilitate communication and coordination between the users to address the issue promptly and find a satisfactory resolution.
  • The decision taken by the Company would be final and binding.

Cancellation by The Rental Studio

  • Company reserves the right to cancel the Order completely or partially without prior information.
  • In such scenarios, the complete deposit amount paid will be refunded within 7 working days.
  • Company reserves the right to prohibit, exclude, or penalize any Users who incur successive cancellations, withdrawals, or no-shows.
  • If the RENTER fails to appear at the location at the second delivery attempt, Company retains the right to cancel the order and may or may not issue a partial refund of the rental amount at its sole discretion.

Damage Policy

General Terms:

  • RENTER agrees to treat the rented Article with great care at all times and be responsible for it while it is in their custody during the rental period.
  • RENTER agrees to take care of all rented items and to return them in the same condition as received.
  • Any damage amount will be first adjusted from the security deposit.
  • In case the damage exceeds the security deposit, then the amount is recoverable at the current Market Price.
  • The RENTER confirms and agrees that LENDER or Company shall have sole authority to decide on the extent of damage caused to the Article.

Assessment and Compensation:

  • Company in coordination with the LENDER shall assess the cost and compensation to remedy the damage (“Damages”).
  • Rental for such articles will continue until full payment towards such compensation is received by the Company.
  • RENTER agrees to pay for any damage to, loss of, or any theft (disappearance) of items, regardless of cause or fault.
  • Company or LENDER reserves the right to not return the RENTER’S Security Deposit at the time of Product return if any Product impairment is suspected.

Repairable Damage:

  • For any damage that leads to a loss of function of the Product that is repairable, the actual cost of repair will be recovered.
  • LENDER expressly reserves the right to choose the repair method and venue, within reasonable market value terms.
  • LENDER and RENTER agree to be bound by the report of LENDER’S chosen repair venue as to the cause and repair cost of the damage to the Article.
  • LENDER shall be entitled to recover any additional costs it incurs in terms of transportation, consultation fee, etc., with reasonable market value terms.

Loss or Irreparable Damage:

  • In case the Article is lost, the RENTER shall intimate Company immediately and shall either file an FIR or assist LENDER in filing the FIR.
  • The RENTER shall be liable to pay a penalty amounting to the existing market value of the Article at the time of such incident.
  • If the Article becomes damaged beyond repair, the RENTER shall pay between 70% to 100% of the replacement value.
  • Company in coordination with the LENDER shall solely determine the replacement value based on the extant market price, age, and condition of the Product at the start of the rental term.

Specific Guidelines:

Furniture Category:

  • Minor scratches on wooden furniture below specified dimensions will be ignored as normal wear and tear.
  • Chips and breakages in timber above specified dimensions will be charged.
  • Tear in upholstery will result in a charge towards replacement.
  • Stains on upholstery not removable via dry cleaning will result in a charge for upholstery replacement.
  • Damage to mirror or glass material will be chargeable to the RENTER.

Gaming Category:

  • RENTER is liable to pay for any damage, up to the existing market value of the Article.
  • Costs of repairs or replacements due to misuse or damage borne by the RENTER.
  • Variations or signs of tampering found will result in charging a fee and can lead to a lawsuit.

Entertainment Category:

  • RENTER responsible for lost or damaged pieces, charged for replacement.
  • Commitment not to make defacements on games or components.
  • Normal wear and tear below specified dimensions ignored.
  • Unusable damage results in a charge equal to the value of the whole item.

Appliances Category:

  • RENTER liable for damages or losses during the rental period.
  • Unusable damage results in a charge equal to the value of the appliance.
  • Specific charges for damages to refrigerator, washing machine, microwave, television, water purifier, etc.

General Decision:

  • Damages not explicitly defined as 'normal wear and tear' will be assessed at the sole discretion of the LENDER and/or Company.
  • Company’s decision regarding such matters shall be final and binding.

Maintenance Policy

  • LENDERS on the Platform have the option to offer service and maintenance for their listed products.
  • This offering is not mandatory, and LENDERS can choose to provide this service at their discretion.
  • LENDERS not obligated to provide service and maintenance if the issue arises from RENTER misuse or negligence.
  • Routine maintenance not covered under this policy.
  • Issues caused by external factors not LENDER's responsibility.
  • LENDER may deliver the product with any make or brand unless specified.
  • After reporting any issue, Lender in accordance with Company will analyze the issue and ensure resolution in 5-7 working days.
  • RENTER must contact LENDER through Company messaging system for mechanical failures.
  • RENTER responsible for documenting and providing evidence of the issue.
  • Expenses associated with repairing mechanical failures may be borne by the RENTER for products without service and maintenance offerings.
  • Unauthorized modifications, parts, or repairs become the property of the LENDER.

Replacement Policy

  • Articles will not be replaced before the End Date or upon the termination of this Agreement.
  • If LENDERS offer service and maintenance, repairs carried out within 5-7 working days.
  • In case of national holidays, considerate delays.
  • If the issue is not resolved during repair, the LENDER shall provide a replacement.
  • If replacement not available, Suborder terminated early, and the amount fully refunded to the RENTER.
  • Refer to Early Termination Policy.

Duties of the RENTER

  1. Ensure legal use of borrowed items.
  2. Provide accurate and complete information.
  3. Do not allow third parties to use the account.
  4. Keep provided data accurate, up-to-date, and complete.
  5. Ensure confidentiality and security of login data.
  6. Comply with applicable laws.
  7. Comply with LENDER's directions for safe item use.
  8. Keep the product safe; do not overclock or modify without permission.
  9. Immediately notify Company of vices, defects, dangers, or third-party claims.
  10. Return items in the same condition.
  11. Acknowledge Company doesn't verify item descriptions; inspect items before booking.
  12. Present government-issued identification at item collection.
  13. Verify the perfect working condition of items.
  14. Maintain cleanliness and condition of the product.
  15. Seek professional help for correct use of the item if unqualified.
  16. Do not open or modify item parts.
  17. Keep the rented article until returned.
  18. Acknowledge the installation of location trackers.
  19. Contact authorities for damage or incidents.
  20. Contact LENDER for authorization for item repair.
  21. Return items in the same condition, responsible for repair costs.
  22. Leave a review responsibly.
  23. Acknowledge the license to possess and use the item.
  24. Do not allow third parties to use the item.
  25. Do not use the item for commercial purposes without written acceptance.
  26. Use the item within the specified geographical area.
  27. Do not use the item for illicit purposes.
  28. Do not alter or modify the item without written permission.
  29. Provide ladder and accessibility items for installation.

11. Indemnification

The RENTER shall indemnify, defend and hold Company and LENDER harmless from and against any claim, demand, cause of action or loss or liability (including, but not limited to, attorneys’ fees and costs) for any Product damage or personal injury arising from the RENTERS use of the Product by any cause, except to the extent such is caused by LENDER’S or Company’s negligence. The provisions of this clause shall survive the termination of this Agreement with respect to any claim or liability accruing before such termination. In no event shall LENDER or Company be liable for any direct, indirect, special or consequential loss or damage arising out of RENTER’S use of the Articles.

12. Inspection

Company or LENDER reserves the right to inspect the Article delivered to the RENTER during the term of the Agreement. RENTER shall ensure that the representative of Company or LENDER is provided with proper access to all the Products/premises for inspection.

13. Ownership of Products

  • We are not a rental product company.

  • We do not own products and are not in the business of renting products to the public.

  • We provide an online platform where product owners and those in need of a product can meet and share products amongst themselves subject to these Terms.

  • LENDER retains ownership of the equipment given on a rental basis.

  • RENTER is forbidden from sub-leasing the equipment for any gain.

  • Nothing in this Agreement transfers ownership of the Articles to the RENTER.

  • RENTER must notify Company or LENDER if any Article is threatened with seizure and indemnify LENDER and Company against loss and damage.

  • RENTER must inform Company or LENDER of any change in location/constitution/profession/business address.

  • Requests for transfer of ownership are not granted unless explicitly mentioned in writing.

  • Ownership during the Rental Duration resides with LENDER, but RENTER is responsible until return.

14. Assignment

The RENTER shall not assign or transfer any interest in this Agreement or the Articles without the written consent of the Company. Any such transfer or assignment shall be considered as illegal and hence a violation of the terms of this Agreement. The Company reserves the right to assign this Agreement to any third party without prior notice to the RENTER.

15. Early Termination

  • The contract has a lock-in period equivalent to the tenure agreed by the RENTER.
  • Early termination charges for one-time and per-month payment models.
  • RENTER can request early closure by informing the Company at least 2 weeks prior to the selected closure date.
  • Charges calculated based on the difference in monthly rental rates between Contract Tenure and Actual Tenure.
  • Example calculations provided for different scenarios.
  • Note: All offers and discounts void in case of early termination or part return before the agreed-upon minimum rental duration.

ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between the applicable LENDER/S and the RENTER. The acceptance of this Agreement also signifies the acceptance of the RENTER to the terms and conditions on the Company’s website. In the event of any conflict between the terms and conditions on the Company’s website and this Agreement, the terms and conditions on the Company website shall supersede. The Company reserves the right to amend the terms and conditions of this Agreement and on the website from time to time; the RENTER is requested to check the website for updates.

LIMITATION OF LIABILITY

  • When you borrow an Item from a LENDER, you acknowledge that you are entering into a transaction with the LENDER – not the Company.
  • You waive and release Company from any liability arising from your use of the Company Service as a Borrower.
  • Company’s total liability to RENTER shall not exceed the total amount of order values collected from the RENTER.

DISCLAIMER

  • Any current/future orders placed by the RENTER have no connection with any previous orders.
  • Company reserves the right to modify or update these terms and conditions at its discretion.
  • RENTERS will be notified of any changes through official communication channels.
  • For inquiries or concerns, contact the Company service team.
  • By renting products from Aspirebels Private Limited (Company), RENTER acknowledges that they have read, understood, and agreed to the terms and conditions outlined in this policy.
